How Long Do I Have to File a Car Accident Lawsuit in Connecticut?

If you were injured in a car accident, the statute of limitations in Connecticut states that you have between 2 to 3 years from the date of the accident to file a lawsuit. The limit depends on the type of injury and the level of fault -- if it was personal or property damage and if the accident was due to negligence, reckless behavior, or wanton indifference. For the most part, the time limit is never extended, even if you have a pending claim with an insurance company. To determine if you should file a lawsuit and when you should do it, speak with an experienced Hartford County car accident attorney.

Liability Laws After a Car Accident

After a car accident occurs, Connecticut adheres to an “at-fault” rule to determine liability. This means that the driver who is responsible for causing an accident is the one responsible for paying damages, usually through an insurance carrier. While this law is simple in situations where only one driver was at fault, most accidents that occur involve the fault of both parties, no matter how small. An example of “fault” that you may not have considered before would be driving a little bit about the speed limit or failing to put on a turn signal.

In these cases, an injured driver can still recover compensation through Connecticut’s “comparative negligence" rule, found at Connecticut General Statutes section 52-572h. This rule states that an injured party can still file a claim against the negligent party however,

  • The percentage of responsibility they are found to bear will also be deducted from their overall compensation awarded to them. For example, if you are found to be 10% at fault for the accident, the total compensation awarded to you will also be reduced by 10%.
  • You can only pursue a claim if your share of fault is less than 50%
